Helping Employers and Their Benefit Plans Address and Mitigate Data-Related Risks (Brian Bartels)
This session provides an overview of data privacy, security and confidentiality issues confronting employers and employee benefit plans. The session identifies methods to help reduce data-related risks. It also addresses data privacy, security and confidentiality issues for employers who handle employee information, protected health information, and personally identifiable information.
Data Privacy (Nicole Pszczolkowski Moriarty and Jon Breyer)
Companies around the world must comply with new regulations related to processing of personal data. The California Consumer Privacy Act of 2018 (“CCPA”) and the European Data Protection Regulation (“GDPR”) are the most well-known, but there are many more that impose onerous transparency requirements; restrict data monetization business models; force businesses to accommodate rights to access, delete, and port personal data; and create new private rights of action and enforcement risk. We will explore this changing privacy landscape and provide practical advice on how to address these challenges.

Mr. Fields and Ms. Webster will provide a survey of various insurance coverage forms and policy types for first-party and third-party claims. They will offer advice about how policy provisions are interpreted across multiple jurisdictions and how to negotiate the appropriate coverage for business liability and property risks, especially in contractual agreements with third parties. Mr. Fields and Ms. Webster also will focus on what types of coverage are becoming increasingly relevant in the era of #metoo and security breaches.

Overview of Opportunity Zone legislation enacted as part of the Tax Cut and Jobs Growth Act of 2017 including a discussion of potential tax benefits and the structuring of ownership interests in existing Opportunity Zone Property and potential new equity investments in those same properties.
The Crypto-Craze and Blockchain Blues: Initial Coin Offerings and the U.S. Securities Laws in the Wake of Aggressive SEC Enforcement Actions & Impediments to Patent Registration Involving Blockchain (Jason Caskey and Ken Witt)
A discussion of the basics of blockchain technology and its applications, including cryptocurrency. Securities issues arising from “initial coin offerings” and “cryptocurrency exchanges” will be discussed, as well as IP issues and opportunities posed by this revolutionary technology.
Drug Testing Employees in the Era of Medical Cannabis (Kasey Cappellano)
Kasey Cappellano will discuss benefits and risks of drug testing employees in light of the growing trend of marijuana legalization, and will provide recommendations related to drug testing policies and best practices.
Ethics Trivia: Real-Life Issues Facing Corporate Counsel (Anna Berman)
