The session identifies methods to help reduce data-related risks. It also addresses data privacy, security and confidentiality issues for employers who handle employee information, protected health information, and personally identifiable information. |

Data Privacy (Nicole Pszczolkowski Moriarty and Jon Breyer) Companies around the world must comply with new regulations related to processing of personal data. The California Consumer Privacy Act of 2018 (“CCPA”) and the European Data Protection Regulation (“GDPR”) are the most well-known, but there are many more that impose onerous transparency requirements; restrict data monetization business models; force businesses to accommodate rights to access, delete, and port personal data; and create new private rights of action and enforcement risk. We will explore this changing privacy landscape and provide practical advice on how to address these challenges. |

They will offer advice about how policy provisions are interpreted across multiple jurisdictions and how to negotiate the appropriate coverage for business liability and property risks, especially in contractual agreements with third parties. Mr. Fields and Ms. Webster also will focus on what types of coverage are becoming increasingly relevant in the era of #metoo and security breaches. |
