Kutak Rock’s Employment Law Group proudly presents its annual Employment Law Seminar on November 8, 2018 from 8:30 a.m. to 3:45 p.m. at the Scott Conference Center, 6450 Pine Street in Omaha.

This year’s seminar is titled "Canvassing Employment Law: A Midterm Review," and is all about developments and updates from the past two years and will deliver practical advice on issues related to new trends, immigration law, wage and hour law, arbitration agreements, the #MeToo movement, anti-poaching laws, the Defend Trade Secrets Act, benefits and ethics. 5 CLE Credits (1 Ethics) in NE and IA Approved. 5 HRCI Credits.

Agenda

8:30 AM - 9:00 AM: Registration

9:00 AM - 10:00 AM: Political Shakeup: Employment and Labor Law Changes and Trends

Meaghan Gandy and Ryan Calley will discuss updates in employment and labor law, including recent discrimination cases, as well as changes and trends at the EEOC and NLRB. The presentation will also cover new cases from the Supreme Court concerning employment law.

10:00 AM - 10:20 AM: Break

10:20 AM - 10:50 AM: Wage & Hour Update: Casting Your Vote for Compliance

Gigi O’Hara will provide her annual legal and regulatory update regarding developments in wage and hour law. She will also offer practical tips and strategies for compliance, and discuss facilitating protective measures for employers.

10:50 AM - 11:20 AM: The Great Debate: Mandatory Arbitration or Not

Kate Jones will discuss the pros and cons of requiring mandatory arbitration as a condition of employment, including the U.S. Supreme Court’s approval of class action waivers in arbitration agreements and other important considerations in drafting an enforceable arbitration agreement.

11:20 AM - 11:50 AM: Strength in Numbers – The #MeToo Movement, One Year Later

Marcia Washkuhn will talk about the response employers and lawmakers have had and are continuing to have to the #MeToo Movement, including pending and adopted legislation, effects on juries and the judiciary, as well as industry and corporate trends and responses. In addition, she will discuss new ways employers are providing bystander and first responder training, conducting workplace investigations and treating accused harassers as a result of the movement.

12:30 PM - 1:30 PM: Ethics Trivia: We’re Canvassing for the Right Answers

Anna Berman will present an ethics trivia game using real, and sometimes unbelievable, examples from around the country to test your ethics prowess in a fast-paced race to victory.

1:30 PM - 1:45 PM: Break

1:45 PM - 2:15 PM: Protecting Your Base: Updates to the Defend Trade Secrets Act and Anti-Poaching Rules

Kasey Cappellano will present on emerging issues under the Defend Trade Secrets Act and developments in Anti-Poaching Rules.

2:15 PM - 2:45 PM: The Immigration Facts on the Ground

Clete Samson will discuss immigration policies and reforms over the last two years that have impacted employers including proper management of employees with expiring work authorization as a result of DACA and TPS terminations, ICE’s increased worksite and I-9 enforcement measures, and USCIS’ increased scrutiny of H1B visa petitions.

2:45 PM - 3:00 PM: Break

3:00 PM - 3:30 PM: Elect to Have a Winning Benefit Plan

Brian Bartels’ presentation will highlight changes to laws and guidance affecting employee benefit plans and identify steps employers should take to help ensure their plans remain compliant.
