Kutak Rock served as bond counsel in connection with the issuance of $38,680,000 of California Enterprise Development Authority Student Housing Revenue Refunding Bonds (Provident Group – Pomona Properties L.L.C. Project) Series 2024A and $1,365,000 of California Enterprise Development Authority Student Housing Revenue Refunding Bonds (Provident Group – Pomona Properties L.L.C. Project) Taxable Series 2024B for the purpose of (i) refunding the California Statewide Communities Development Authority Student Housing Revenue Bonds (Provident Group – Pomona Properties L.L.C. Project), Series 2013A and California Statewide Communities Development Authority Subordinate Student Housing Revenue Bonds (Provident Group – Pomona Properties L.L.C. Project), Series 2013B, previously issued to finance (a) the acquisition of certain unimproved real property immediately adjacent to the Pomona, California campus of Western University of Health Sciences and (b) the acquisition, construction, furnishing and equipping of an approximately 174,533 square foot student housing facility consisting of 202 apartment style units containing 305 beds, for lease or sublease to eligible tenants, with related amenities, and including approximately 10,217 square feet of academic/administrative space, for lease to the University, (ii) funding a reserve fund required in connection with the Series 2024 Bonds, (iii) paying deferred asset management fees, and (iv) paying the costs of issuance of the Series 2024 Bonds. 

Eligible tenants mean, in order of priority, (a) the University pursuant to the Housing Facilities Lease, (b) students registered in an academic program at the University, (c) visiting faculty serving at the University on a temporary basis, (d) other persons participating in any University sponsored activity, and (e) regular full-time faculty and staff of the University.
