On Tuesday, November 16, 2021, members of Kutak Rock’s Government Services Team and National Employment Law Group will present a CLE webinar titled “Understanding President Biden’s Vaccine Mandate for Federal Contractors: How to Minimize Risk and Maximize Cost Recovery.”

The CLE webinar topics will focus on:

• Who is covered by the Executive Order?
  The Firm’s Government Services Team will discuss coverage for direct or indirect employees, subcontractors, suppliers and exceptions including grantees. We will also cover topics such as effective dates and when vaccines are required.
• When does the Executive Order apply?
  The presentation will address bi-lateral modifications and the impact on resignations and rehiring, delivery and performance, and options with subcontractors and suppliers. We will also discuss GSA schedules and IDIQs.

• Are there remedies available to recover costs? Also, what types of notices should be given to the government, your subcontractors and your suppliers and when? How do you track costs and calculate delays? If your ability to perform is affected, how do you handle the situation?
  The Government Services team will discuss remedies available to contractors and subcontractors/suppliers such as those available under the changes clause, excusable delay, and defenses to default.
• What is the Executive Order’s impact on the workforce?
  A panel of experienced Kutak Rock employment attorneys will address the most pressing employment law questions presented by the vaccine mandate and provide a brief overview of the risks and challenges federal contractors and their subcontractors face in applying the Executive Order to their current and future employees.
