Shelby Lynn Morbach

Associate

Prior to joining Kutak Rock, Shelby was a judicial law clerk for both the Colorado Court of Appeals and Colorado’s Eighth Judicial District, where she received valuable mentorship in effective written and oral advocacy from a number of seasoned and well-respected judicial officers. Prior to clerking, Shelby interned in the Antitrust Unit of the Office of the Attorney General for Colorado and in the Office of the Commissioner of the Federal Communications Commission, where she gained valuable insight from the perspective of enforcement agencies and regulatory authorities.

Shelby has experience managing large-scale cases across both state and federal court, involving claims such as trade secret misappropriation, trademark infringement and dilution, patent infringement, copyright infringement, breach of contracts, unfair competition, and antitrust. She has also successfully handled DMCA Takedown Notices, office actions before the US Trademark Office, domain name disputes in ICANN’s UDRP forum, and complex commercial arbitration in both JAG and AAA, where her efforts at trial succeeded in overturning her client’s improper expulsion from his LLC by his fellow corporate officers.

Among Shelby’s clients are local Colorado companies, multinational corporations, start-ups, non-profit organizations, and individuals. Her clients occupy such diverse industries as apparel, bio-tech, marketing, public utilities, healthcare, pet grooming, and art.
