Government Project Finance

We advise clients from the earliest stages of project development through acquisition, financing and construction to operation and maintenance of a project.

Kutak Rock has an experienced team of government project finance lawyers located in offices across the U.S.  We advise clients from the earliest stages of project development (requests for proposals, initial teaming and joint venture structuring) through acquisition, financing and construction to operation and maintenance of a project. We understand the unique legal and practical considerations that drive success in government project development. Our depth of experience allow us to actively and creatively help clients reach their goals. We’ve consider transactions from every perspective, and work for development teams, lenders, investors, servicers, construction companies, government entities and rating agencies.

Our experience includes domestic and international equity and debt-financed transactions. We work on private, public-private, concession-based and other transactions on brownfield and greenfield development projects. In addition, we assist governments and their private sector partners to identify project financing options and processes to accomplish their goals in the quickest, most efficient manner possible.

Recent projects facilitated by our firm include:

  • Airports
  • Highways
  • Intermodal facilities
  • Ports
  • Energy (solar, wind, battery demand response, biofuel, nuclear and other power generation and transmission)
  • Utility (water and wastewater)
  • Storage facilities
  • Government-owned hotels and convention centers
  • Student and military housing projects

While the majority of our projects are domestic, we have worked on a first-of-a-kind OPIC political risk insurance project in Ukraine.

We regularly handle third-party financing transactions for clients involved with federal project finance transactions. The federal government and District of Columbia have unique rules that are not encountered at the state or local levels of government, including how these transactions are scored by the Congressional Budget Office and the Office of Management and Budget.  In addition, there are ways that the federal government uniquely handles how money flows to developers and financers.  Our substantial experience in dealing with these unique rules adds value to clients as they move projects forward.

Kutak Rock has worked on over $20 billion of government transactions and we continue to expand our experience and expertise in the area.
