Marcus represents clients in high-stakes litigation across the United States. His practice encompasses shareholder disputes, breach of fiduciary duty matters, ERISA litigation, contract disputes, business tort claims, construction, securities, intellectual property litigation, and government contracts. His broad experience enables him to handle many types of cases, whether those matters are before state, federal or appellate courts.
Marcus also advises clients on the Health Insurance Portability and Accountability Act (“HIPAA”). His HIPAA practice spans advising covered entities on HIPAA compliance, drafting business associate agreements, and representing covered entities in response to subpoenas and investigations.
In his ERISA practice, Marcus focuses on ERISA compliance and litigating ERISA fiduciary and benefits matters. He represents self-insured plans, Taft-Hartley plans, drafts contracts, plan documents and other legal instruments. He has also worked on several collection matters for Funds in federal court.
Additionally, Marcus serves as an advisor to clients on general corporate matters, providing advice and counsel to help his clients achieve their business needs, including drafting and negotiating a variety of contracts.
