Caleb S. Sugg

Caleb focuses his practice on commercial, healthcare, and general civil disputes in state and federal trial and appellate courts across Arkansas and Florida. He has experience in a wide range of business litigation concerning contracts, construction, employment, and mortgage and lien foreclosure. Caleb also has experience as litigation counsel to Florida special tax districts in disputes involving special district governance, land development, Florida sunshine law, and the enforcement, levy, and collection of assessments. In addition, Caleb has experience defending long-term care facilities and their agents or employees against allegations of medical malpractice and wrongful death. He regularly briefs appeals concerning the validity and enforcement of arbitration agreements.

During law school, Caleb interned for the Honorable Edwin G. Torres in the United States District Court for the Southern District of Florida.

  • Authored the winning trial and appellate briefs, resulting in a decision by the U.S. Court of Appeals for the Eleventh Circuit affirming summary judgment piercing the corporate veil and holding a shareholder personally liable for a seven-figure corporate debt.
  • Represented multinational company in dispute with former employee alleging fraud and fraudulent misrepresentation, and successfully obtained dismissal of all claims with prejudice.
  • Appellate counsel to decedent’s estate and author of winning appellate brief, involving the enforceability of an option contract to purchase real property and the application of exceptions to the statute of frauds.
  • Obtained early dismissal of all claims on behalf of multinational financial company in dispute with customer involving allegations of unjust enrichment.
  • Counsel to multinational retail company in response to subpoenas, resulting in court orders quashing subpoenas on multiple occasions.
  • Represented company in litigation filed by pro se plaintiff and successfully obtained order from federal court dismissing all claims with prejudice and entering a permanent injunction prohibiting plaintiff from filing any subsequent lawsuit based on the same facts.
  • Obtained dismissal with prejudice of employment law claims in federal litigation based on res judicata.
  • Representation of multinational financial company in garnishment proceedings filed in Arkansas and Florida.
