Hillary Ellis, Heather Kendrick, and Katie Saunders, Kutak Rock attorneys in the Denver real estate group, recently authored “Navigating COVID-19, Guidance for Landlords and Tenants,” the first in a series of ongoing conversations between CBRE, Inc. and Kutak Rock. The series will focus on real estate issues arising in connection with the COVID-19 pandemic.

In this article, CBRE provides a market status update on downtown Denver while the city remains under a “stay at home” mandate, the market outlook over the next 6-18 months, and workplace considerations related to COVID-19. Kutak Rock provides a legal perspective, including a halt that attorneys have seen in the previously booming market of new leases and lease extensions and a movement toward deferral, rent abatement and other agreements to avoid default. The Kutak Rock authors also provide key lease provisions that should be analyzed on a case by case basis.

Kutak Rock and CBRE state that “this moment is a great opportunity for landlords and tenants to build massive good will and long-term partnerships. They should proactively engage in conversations to understand the impacts of this crisis and focus on creative solutions.”

Hillary Ellis focuses her transactional practice on complex commercial real estate matters related to the development, acquisition and disposition of commercial properties of all types and negotiation of leases for retail, office and industrial properties nationwide.

Heather Kendrick focuses her practice on a broad range of complex commercial real estate transactions across the country, with a concentration on the acquisition and financing of commercial office, multifamily, senior living and retail properties, development and build-to-suit transactions, and the negotiation of office and retail leases.

Katie Crane focuses her practice on a variety of commercial transactions, with an emphasis in commercial real estate matters, including acquisition and disposition, development, financing, land use and zoning, and leasing of commercial properties across the country.

CBRE is the largest commercial real estate services company in the world.
