Kutak Rock attorney Robert J. Toth, II recently authored an article published in the St. Mary’s Law Journal titled “Click to Sue: Defining Receipt of EEOC Notices in the Digital Age.”

The article examines an increasingly important issue in employment discrimination litigation: when an employee is considered to have received notice of their right to sue from the U.S. Equal Employment Opportunity Commission.

Rob discusses recent federal appellate decisions addressing notices delivered by email and through the EEOC’s online Public Portal and considers how courts are applying the 90-day deadline for filing suit in an era when electronic communication has largely replaced traditional mail.
