Andrew Shedlock, a partner in the firm’s Minneapolis office, will be speaking on and moderating a CLE panel titled “Practitioner Supersession – How Cryptocurrency is Changing the Practice of Law” on Thursday, September 15, 2022 at 10:45 a.m. CDT during the Cryptocurrency in the Practice of Law Seminar in Minneapolis, Minnesota.

The seminar will focus on understanding cryptocurrency and other emerging technologies, the current and potential legal implications, and the critical role of lawyers in navigating the responsibility of blockchain and digital assets.

The event will provide updates on:

  • Cryptocurrency Regulations Affecting Your Clients
  • The Intersection of Cryptocurrency Law, Intellectual Property Law, and Securities Law
  • Digital Assets in Divorce, Bankruptcy, and Estate Planning

On the panel, Mr. Shedlock will discuss whether cryptocurrencies and crypto tokens are securities. He remarks, “There are a handful of active civil and federal cases in the country relating to this issue that will impact future regulation. There is potential for the establishment of a new or revised legal test to determine whether a crypto product is a security. Currently, there is a jurisdictional battle between the Commodity Futures Trading Commission and the U.S. Securities and Exchange Commission regarding who controls and can enforce laws relating to crypto products. The only settled law is that bitcoin is a commodity, not a security. Over the next few years, the battle between commodity and security will play out in courtrooms and the halls of Congress.”

Andrew Shedlock uses his securities and regulatory background to advise entrepreneurs, other individuals and businesses on Non-Fungible Tokens (“NFTs”), cryptocurrency and Bitcoin, including securities and contract matters in those areas. Mr. Shedlock and the team at Kutak Rock proactively assist crypto participants to comply with laws and regulations and help drive development and investments in the crypto space.
