Diana Fields, Gigi O’Hara, Marcia Washkuhn, Richard Olmstead to Present Business Recovery Solutions

Kutak Rock attorneys Diana Fields, Gigi O’Hara, Marcia Washkuhn and Richard Olmstead will present legal issues and recovery solutions for businesses recovering from COVID-19 pandemic’s impact at the virtual Arapahoe/Douglas Works! Business Recovery Conference on October 28. 

Gigi O’Hara, from the firm’s Omaha office, will open the conference with a discussion about safety and compliance considerations under OSHA due to COVID-19 in the workplace. Diana Fields, from the Denver office, will follow with a brief discussion of how to handle leave issues for employees who have been affected by COVID-19, including under the Colorado Healthy Families and Workplaces Act. Marcia Washkuhn, from the firm’s Omaha office, will address employee accommodation requests under the ADA related to COVID-19. Richard Olmstead, in the Wichita office, will conclude with a discussion about what type of litigation employers might expect arising out of COVID-19 issues.

Ms. Fields has represented corporate clients and senior management in federal and state courts and in alternative dispute resolution and administrative agency proceedings involving employment-related disputes. She provides day-to-day advice on all aspects of the employee lifecycle, including advising on discipline and terminations, drafting employee handbooks and employment and separation agreements, conducting sexual harassment training and investigations, and ensuring compliance with state and federal laws and regulations.

Ms. O’Hara leads the firm’s national OSHA Compliance & Defense Practice Group and assists clients responding to OSHA inquiries following complaints of retaliation or alleged unsafe workplace conditions, as well as investigations following injuries, accidents or fatalities. She is an experienced trial attorney who has litigated and tried cases to verdict before a jury in state and federal court under a variety of employment laws.

Ms. Washkuhn is chair of the firm’s National Employment Group, leader of the Omaha Employment Group, and serves as Kutak Rock’s employment counsel. She focuses her practice entirely on representing corporate and management clients in employment matters.

Mr. Olmstead focuses his practice on complex litigation in employment law. He counsels and defends employers and management in all aspects of the employment relationship including, but not limited to, defense of claims of discrimination, harassment, and retaliation; defending wage and hour claims; and negotiating and litigating employment contracts, covenants not to compete, trade secret agreements, arbitration agreements, and severance agreements.
