Ken Witt, Marc Lieberman Author Article for Law360

Kutak Rock partners Ken Witt and Marc Lieberman recently authored an article, “PE Investors Should Reject Life Tenure For General Partners,” for Law360. The article examines the new Institutional Limited Partners Association’s (ILPA) position on the tenure of general partners entrusted by institutional investors in private equity and venture capital funds. 

Mr. Witt and Mr. Lieberman provide several suggestions for removal provisions in private equity and venture capital limited partnership agreements.  The article focuses on the standard for determining when cause for removal is triggered, as opposed to what actions by the general partner constitute cause for its removal.
