Bruce Wilson Publishes on PROMESA and on Provisions in Bankruptcy-Remote Organizational Documents

Kutak Rock partner Bruce Wilson published two articles in the mondaq website newsletter of September 28, 2016.

The first of the articles, "PROMESA: A Summary Of The Puerto Rico Oversight, Management, and Economic Stability Act," describes PROMESA as new and unique legislation that has not yet been applied or been the subject of any court or similar proceeding which could provide further guidance on its interpretation and application.

The second article, "The Enforceability Of Independent Director Or Independent Member Provisions In A Bankruptcy-Remote Entity's Organizational Documents," discusses two recent bankruptcy court opinions that invalidated "golden share" provisions in a bankruptcy-remote entity's organizational documents.

Wilson practices primarily in the areas of bankruptcy, workout and Uniform Commercial Code matters.
