Kutak Rock attorneys Marc Lieberman, Mark Lasee and Andrew McNichol authored an article, "When Trustees Have a Duty to Delegate Investment Management," for the October 2015 issue of The NAPPA Report, the official publication of the National Association of Public Pension Attorneys.
In the article the authors explain that trustees of public retirement systems no longer have to "go it alone" in making investment decisions and should be ready to select professional investment managers when appropriate. The authors stress that the old rules prohibiting delegation of investment management are outdated, and that the new complexity of retirement investment plans essentially obligates trustees to seek the guidance of third-party professionals.
