Kutak Rock attorneys recently achieved a significant legal victory for their client, Jones Eagle LLC, in a high-profile federal case in Arkansas. The legal team, led by Alexander Jones and supported by Fred Davis and co-counsel Robert Chang of the Korematsu Center at the University of California - Irvine School of Law, successfully challenged two Arkansas state laws that were set to impose discriminatory restrictions on businesses.
Jones Eagle LLC, a digital data center operator, sought to halt the enforcement of Act 636 of 2023 (“Foreign Ownership of Agricultural Land Act”) and a 2024 amendment to the Arkansas Data Centers Act of 2023. Kutak’s team argued these laws were unconstitutional and preempted by federal law. The team’s efforts resulted in a temporary restraining order and preliminary injunction, both issued by Chief U.S. District Judge Kristine G. Baker, which prevent the State from enforcing the laws against Jones Eagle LLC.
The State has indicated plans to appeal the decision to the Eighth Circuit. Until then, the preliminary injunction safeguards Jones Eagle LLC’s operations, allowing them to continue operating their business without undue interference.
