Brian Bartels, John Westerhaus Present UBA Compliance Webinar Series

Kutak Rock partner Brian Bartels and associate John Westerhaus will present a live 60-minute compliance webinar, hosted by United Benefits Advisors® (UBA), on November 14, 2023, at 1 p.m. CDT. The monthly webinar series from UBA helps employers and HR professionals learn about rapidly changing employee benefits laws.

This month’s webinar, “Compliance Considerations for Self-Funding,” will help attendees gain an understanding of the rules and regulations that govern self-insured health plans. Attendees will gain insight into the plan exemption from state insurance laws, the Affordable Care Act and Consolidated Appropriations Act reforms that apply and how they differ from fully insured plan requirements, and required plan documents, annual notices, and non-discrimination tests.

Brian works with clients on employee benefit plan issues and advises on group health plans, wellness programs, the Patient Protection and Affordable Care Act (ACA), HIPAA, ERISA, the No Surprises Act, mental health parity requirements, cafeteria plans, health savings accounts, and other health and welfare plans. He regularly drafts and negotiates service agreements and business associate agreements for employee benefit plans. Brian also prepares plan-related documents and employee communications and counsels clients on benefit plan design and administration issues. Additionally, he advises clients on employee benefit issues in the context of mergers, acquisitions, and divestitures.

John advises plan sponsors and fiduciaries regarding the design, administration and operation of employee benefit plans. This includes compliance issues relating to benefit determinations, plan disclosures and policies, the drafting of plan documents and amendments, and the review of service provider agreements and investment documents. John has worked extensively with compliance issues affecting Taft-Hartley and governmental retirement plans and has also represented such plans in litigation or other adversarial proceedings.
