Subchapter V of Chapter 11 went into effect in February of 2020, and it quietly came into use as Covid-19 restrictions were being put into place. Since its inception, Subchapter V has been a flexible, functional process to reorganize a small business debtor. This presentation will quickly review the highlights of Subchapter V before diving into the normal causes, procedural requirements for debtors to meet, the typical path of a case, and what to expect after a plan confirmation.
