Gigi O’Hara to Speak at 2022 HR Nebraska State Conference
News | July 29, 2022Kutak Rock partner Gigi O’Hara has been invited to present for a second year at the 2022 HR Nebraska State SHRM Conference, August 24-26, 2022. The conference is known as one of the Midwest’s best industry events for HR professionals and the largest conference of its kind held in Nebraska, attracting attendees from Nebraska and the surrounding states.
On August 26 at 1:15 p.m. CDT, Ms. O’Hara will present her session: "FLSA Mythbuster: Debunking Myths and Misconceptions About the Fair Labor Standards Act," which will focus on wage and hour compliance under the FLSA, including some common myths and misconceptions that are often deeply ingrained in workplace practices.
Ms. O’Hara leads Kutak Rock’s national Wage and Hour Defense Group. She has defended several significant, large-dollar wage and hour lawsuits brought under various theories, including exemption misclassification, independent contractor misclassification, unpaid overtime, unpaid minimum wage, unlawful deductions, improper calculation of the regular rate, off-the-clock work, missed meal and rest breaks, among other alleged violations. She also regularly defends clients against individual wage claims and wage and hour audits initiated by the U.S. Department of Labor.
Throughout her career, Ms. O’Hara has helped clients achieve several favorable wage and hour outcomes. Highlights include successfully opposing conditional certification of various FLSA collective actions, achieving decertification of conditionally certified classes, and defending numerous wage and hour lawsuits in litigation across the United States. In one such recent litigation, Ms. O’Hara achieved summary judgment dismissal for a client who was defending a class of 2,500 personal care assistants claiming joint employment, unpaid overtime and minimum wage violations under the FLSA.
