Kutak Rock Is Counsel on Large 167 MW Solar Project

Kutak Rock LLP acted as negotiating counsel to Recurrent Energy for a major 167 megawatt direct current solar photovoltaic facility to be constructed at Naval Air Station Lemoore in California.

Through this agreement, the Navy will receive electrical infrastructure upgrades including on-base, biofuel-capable, back-up generation and other upgrades to support uninterrupted base operations during grid outages in exchange for use of its land. The legal authority for the Navy to enter into the project is 10 USC 2667 (Enhanced Use Lease).

The Navy says this project will enable the Navy to meet critical renewable energy and security goals. The facility will be the largest solar operation on Department of Defense land, with the ability to power more than 23,000 homes.
