Kutak Rock attorneys Brian Bartels and John Schembari authored an article, “Fiduciary Duties in the Public Sector,” in the April 2015 edition of Benefits Magazine.
The article provides governmental plan fiduciaries with information to assist with their responsibilities. Bartels and Schembari discuss the definition of fiduciary, the sources of fiduciary duties, the general duties applicable to fiduciaries of governmental plans, and issues to consider when delegating fiduciary responsibilities. The article also explains the best practices to help governmental plan fiduciaries fulfill their duties and avoid liability.

Bartels is a corporate associate in the firm’s Omaha office. He works with public governmental, tax-exempt, and private sector clients on employee benefit plan issues. He advises clients on health and welfare plans, the Patient Protection and Affordable Care Act, HIPAA, cafeteria plans and fringe benefits.
Schembari is chair of the corporate finance department and a partner at the firm’s Omaha office. He concentrates his practice primarily in employee benefits, executive compensation, tax, corporate and privacy law.
