Kutak Rock partner Peter Barrett will speak at the National Association of Bankruptcy Trustees (NABT) 2026 Annual Conference on Monday, August 10 during the panel discussion “Voting, Cramdown, and the Consensual Plan: Strategies to Encourage Plan Confirmation.” The session begins at 2:30 p.m. EDT and will explore practical strategies for successfully confirming a Subchapter V plan.

Peter and his fellow Chapter 11 practitioners will provide an overview of Section 1191 of the Bankruptcy Code and discuss key considerations in the plan confirmation process, including voting requirements, approaches for addressing non-voting classes, confirmation hurdles and cramdown procedures. The panel also will share practical guidance for achieving a consensual plan, including effective use of the Subchapter V trustee to facilitate plan confirmation.

Based in Kutak Rock's Richmond office, Peter represents unsecured and secured creditors, trustees, lessors, equity holders and corporate debtors in insolvency matters, including Chapter 11 reorganizations, business liquidations and loan workouts. He regularly represents clients in bankruptcy courts throughout the country and serves as a Chapter 7 bankruptcy trustee for the Eastern District of Virginia, Richmond Division.
