Kutak Rock Attorney Thomas J. Salerno to Moderate Panel at American Bankruptcy Institute Conference
News | August 11, 2026Kutak Rock Scottsdale attorney Thomas J. Salerno will moderate a panel at the 2026 Southwest Bankruptcy Conference in Las Vegas, Nevada on September 10, 2026. The panel, titled “Four Alternatives After Purdue: Is the Door Shut on Third-Party Releases?” will explore the alternatives available to plan proponents in addressing third-party releases in the post-Purdue world. In Harrington v. Purdue Pharma L.P. the U.S. Supreme Court ruled 5–4 that the Bankruptcy Code does not allow a Chapter 11 reorganization plan to release non-debtor third parties from civil liability without the explicit consent of affected claimants. However, multiple loopholes and alternative paths remain active in bankruptcy courts.
Tom will be joined on the panel by three other attorneys specializing in this topic as well as U.S. Bankruptcy Court Judge Thomas Horan from the District of Delaware.
