Ruth Marcott Authors Chapter for Bloomberg Law’s Benefits Guide Book

Kutak Rock of counsel Ruth Marcott recently co-authored a chapter titled, “Requirements for Qualified Retirement Plans, Accrual Rules” for Bloomberg Law’s Benefits Guide 2020 publication.

In the chapter, Ms. Marcott provides information and practice tips for plan practitioners regarding the following:

  • Benefit accrual rules and requirement basics;
  • Accrual benefit formulas that include the 3% method, the 133 1/3% rule, and the fractional method; 
  • Year of participation basics for accrual purposes;
  • Vesting rules;
  • Anti-cutback rules; and
  • Reduction of future accruals basics.

Bloomberg Law’s Benefits Guide is intended to be a resource for non-benefits practitioners that is easy to understand and explains complex topics in a straightforward way.

Ms. Marcott co-authored the chapter with former Kutak Rock employee benefits attorney Kaitlin Riessen.

An accomplished employee benefits specialist, Ruth Marcott provides advice and guidance on compliance with federal and state benefit laws including ERISA, the Internal Revenue Code, the

Affordable Care Act, and the Multiemployer Pension Plan Amendments Act of 1980. Combined with her extensive litigation and other dispute-related experience, she is an effective advocate defending audits or investigations by the DOL or the IRS. She also acts as fund counsel to Taft-Hartley funds.
