J. Michael Low, Kutak Rock attorney in the Scottsdale office, was recently quoted in a September 4 Captive Insurance Times article titled, “Artex granted motion to dismiss class action lawsuit.” 

The article discusses a recent class action victory secured by the firm and other defense counsel before the U.S. District Court for the District of Arizona – Phoenix Division. 

Mr. Low explains “that it’s ‘important’ there will not be a class action. It substantially limits the possible exposure to the individual plaintiff’s claim against each defendant.” He also comments on the outcome of future 831(b) captive court cases and previous decisions in favor of the IRS.

Mr. Low is a member of the firm’s Insurance Regulatory and Compliance Practice. He sits on the boards of 15 captive insurers and serves as an elected board member and immediate past president of the Arizona Captive Insurance Association.
