Kutak Rock Prevails in the Eighth Circuit for Client Rembrandt

Kutak Rock attorneys Alain Baudry and Matt Veenstra, a trial team in the Minneapolis office, prevailed on behalf of client Rembrandt Enterprises, Inc. before the United States Court of Appeals for the Eighth Circuit. The Court rejected the appeal of the trial court judgment by appellant Dahmes Enterprises following a four-day trial before the United States District Court for the Northern District of Iowa.

At trial, Dahmes claimed both $3.47 million in lost profits and additional “business interruption” damages of $329,000 following cancellation of an industrial dryer project by Rembrandt. Following trial, the district court denied both items of damages and ordered Dahmes to return $2.79 million dollars to Rembrandt. Dahmes based its damage claims on an alleged historical analysis of profits on prior projects. In denying the damages claim, the district court noted that Kutak Rock lawyers had done “an excellent job of demonstrating that Dahmes’ cost estimates are virtually worthless.”
