Kutak Rock attorney Michelle Ueding presented at the Iowa-Nebraska ESOP Chapter 2015 Nebraska Mini Conference on October 27 in Grand Island, Nebraska. The topic was “The Role of a Fiduciary Committee.”
Ueding and co-presenter Charles Smith of First National Bank of Omaha provided information on recent activity by the Department of Labor and U.S. Supreme Court that redefined the fiduciary rules that apply to employee stock ownership plans (ESOPs). The primary focus of the presentation was identifying plan sponsor responsibilities and using a fiduciary committee to fulfill those responsibilities.
