Mariza McKee Co-Authors “NSAA Simplifies Blue Sky Form D Filing Process”

Kutak Rock partners Robert Ahrenholz and Mariza McKee co-authored an article, “NSAA Simplifies Blue Sky Form D Filing Process,” in the March 2015 issue of the Regional Center Business Journal, the Association to Invest in the USA’s (IIUSA) publication committed to industry development and public education of the EB-5 Regional Center Program.

 

The North American Securities Administrators Association introduced the Electronic Filing Depository (EFD) in late 2014.  The article provides information on the simplification of the Form D blue sky filing process for EB-5 issuers. Ahrenholz and McKee discuss how the EFD program provides a one-stop mechanism for EB-5 users to submit Form D filing fees electronically. While the EFD program makes blue sky filings easier, the article also outlines some drawbacks, such as increased filing costs, limited state participation, and hard copy filing requirements for additional document or supplemental information requests.
