Enforcement of City Franchise Ordinance Enjoined

A litigation team from Kutak Rock’s Denver office, including Tom Snyder and Tiffanie Stasiak with additional support from Michael Frandina, secured a very significant victory for a longtime telecommunications client of the firm.

Following a five-day trial in the United States District Court for the District of New Mexico, the Court enjoined a city from enforcing an ordinance that would have quadrupled the franchise fees paid by the client and passed through to its customers. The court held that the ordinance violated the Federal Telecommunications Act of 1996. The judgment was a victory for both our client and its customers, who would have faced the brunt of the massive franchise fee increase.
