Mr. Lu is a partner in the Washington, DC office of Kutak Rock LLP. He conducts an extensive practice in public finance, counseling state and local governmental issuers, private borrowers and financial institutions in bond and loan transactions. He has served as bond, underwriter, purchaser and credit enhancement counsel in financings in a variety of industry sectors, particularly in affordable housing, hospital and health care, education and transportation. Mr. Lu also provides federal tax analysis and advice pertaining to tax-exempt transactions under Section 103 of the Internal Revenue Code and is a member of the firm’s National Public Finance Tax Group.

Mr. Lu represents commercial and investment banks in public offerings and private placements of debt involving letters of credit, liquidity facilities, direct purchase of bonds, bridge loans and permanent loans. Notably, he worked with a team of Kutak Rock attorneys in a successful tender offer and refunding of approximately $1.8 billion of revenue bonds for the water and sewer system of the City of Detroit in the midst of the largest municipal bankruptcy case in U.S. history.

Mr. Lu has counseled governmental and private entities in transactions involving public-private partnerships. He recently represented a homelessness and mental health provider in Cuyahoga County, Ohio in negotiating and concluding the first county government “pay-for-success” contract (or “social impact bond”) in the U.S.

In addition to public finance, Mr. Lu has worked on acquisition, debt and equity transactions involving privately held businesses. He previously served in the role of outside general counsel to a medical device company and an information technology company.
