Development and Improvement Districts

Kutak Rock has served as bond counsel and/or disclosure counsel in hundreds of financings of development districts in various states.  Generally, these transactions finance the construction of public infrastructure such as streets, water and sewer facilities, and parks in residential and commercial developments.  The districts levy special taxes on property owners in the districts to repay such indebtedness. 

Our firm has vast experience with all forms of special district financings in Colorado, sanitary and improvement district financings in Nebraska, and community improvement and transportation development districts in Kansas.  We have also represented districts with comparable purposes in other states.  Such districts use various types of debt instruments, including general obligation bonds, revenue bonds, tax increment bonds, short-term warrants and STAR bonds, to accomplish their financing goals.

In addition, our firm serves as general counsel, including as issuer's counsel relative to the special district financings, to community development and special districts in Florida and Alabama, including multi-county stewardship districts for some of Florida’s largest community developers.
