Scott E. Wray


Scott believes in guiding his clients on day-to-day and long-term strategic business issues and transactions.

Scott is a native of Northwest Arkansas and he has seen the area emerge from modest beginnings to one of the country's most dynamic economic regions. During his legal career, which spans more than two decades, Scott has provided legal services to individuals and businesses ranging from closely held to Fortune 500 companies throughout Northwest Arkansas and beyond. He has successfully represented clients in matters including commercial transactions, litigation in state and federal courts and agencies, as well as in arbitrations, and has participated in multiple informal dispute resolutions.

Scott believes in guiding his clients on day-to-day and long-term strategic business issues and transactions. His representation includes entity creation and governance, internal investigations and event response, regulatory and compliance matters, acquisitions and dispositions of assets and equity interests, real estate transactions, and employee policy development and implementation. His experience also includes drafting employment contracts, non-compete agreements, non-disclosure agreements and policy manuals. Scott also has extensive involvement in employment discrimination charges, wage and hour disputes, wrongful discharge claims, and civil rights cases before federal and state courts, as well as before the United States Equal Employment Opportunity Commission (EEOC).

A representation of Scott's transactional and litigation experience includes:

  • Successfully argued on behalf of employer for summary judgment and dismissal regarding employee's defamation and false light claims.
  • Argued successfully before the Eighth Circuit Court of Appeals regarding improper application by opposing party of arbitration provision.
  • Represented employer in Fair Labor Standards Act litigation pursued by the United States Department of Labor (DOL) and helped to obtain resolution of matter for less than half of damages claimed by DOL.
  • Obtained directed verdict in jury trial on behalf of local medical care facility employer regarding an employee's wrongful discharge claim.
  • Represented employer against putative class action claims pursued by the EEOC regarding systemic violations of the Americans with Disabilities Act concluding with the negotiated Conciliation Agreement with compensation significantly below the damages alleged by the EEOC.
  • Obtained summary judgment and dismissal in favor of real estate agent regarding fraud and misrepresentation claims of home buyer.
  • Obtained dismissal in favor of defendant food vendor of federal case alleging violations of Civil Rights under 42 U.S.C. Section 1983 and Arkansas Deceptive Trade Practices Act.
  • Obtained jury trial defense verdict in admitted negligence motor vehicle accident.
  • Served as seller's counsel in clearing significant title issue and sale of real estate development for multifamily residential use.
  • Served as seller's counsel for asset sale of multi-million-dollar turkey production facilities.
  • Argued successfully for dismissal of putative class action case pursued under alleged violations of Arkansas Usury Law, Uniform Commercial Code, Truth in Lending Act, Arkansas Deceptive Trade Practices Act and the Racketeer Influenced and Corrupt Organizations Act.
  • Served as buyer's counsel for asset purchase of multi-million-dollar sale of chicken production and processing facility.
  • Successfully defended employers at trial level and appellate level, including respective Supreme Courts, in Arkansas and Oklahoma regarding work related injury claims.
  • Served as buyer's counsel for purchase of assets for popular women's fashion retail operations.
  • Served as counsel for developer of large-scale commercial retail shopping center.
  • Represented respondent construction company in arbitration resulting in award for less than 3% of damages alleged by petitioner.
