Jacob Song


A registered patent attorney with the United States Patent and Trademark Office, Jacob primarily assists clients in litigation involving intellectual property, commercial matters, and business disputes.

Jacob’s practice focuses primarily on IP litigation and commercial litigation matters. In addition to his extensive litigation background, his practice also includes patent prosecution, trademark prosecution, and trademark portfolio management and enforcement.

His pro bono work includes assisting nonprofit organizations with IP issues, including trademark registrations.

  • Trial counsel for defendant Arctic Cat in Bombardier Recreational Products, et al. v. Arctic Cat, et al. (D. Minn) in patent infringement action. Following a three week jury trial, Arctic Cat prevailed, as the jury found all of the asserted patents were invalid.
  • Representation of patent owner, a home hardware manufacturer, in inter partes review proceedings before the Patent Trial and Appeal Board (PTAB) relating to two challenged patents.
  • Representation of patent owner, an active particle technology apparel company, in inter partes review proceedings before the PTAB involving textile polymer technology.
  • Representation of home hardware manufacturer in patent infringement litigation.
  • Defense counsel to magnet manufacturer in ITC litigation involving rare earth metal magnet technology; complaint dismissed on eve of trial.
  • Defense counsel to data aggregator in patent infringement suit involving debt collection software employing skip tracing technology; obtained favorable settlement prior to Markman hearing.
  • Counsel to major country music awards show in trademark infringement action asserting senior rights predating registrant’s use of disputed mark; obtained settlement and co-existence agreement. Represented same client in parallel opposition proceedings before Trademark Trial and Appeal Board.
  • Defense counsel to major agribusiness feed supplier in the Northern District of California involving breach of contract claims; obtained dismissal of federal claims.
  • Obtained summary judgment in favor of local municipality against federal civil rights claims and environmental access claims. Defeated motion for class certification, and obtained summary judgment dismissing all federal claims.
