Tom represents manufacturers, gas companies, service personnel and individuals in lawsuits arising out of explosions/fires and other product liability incidents both nationally and regionally.

Tom has defended landowners, lenders and title insurers in real estate litigation. He has successfully tried cases in Minnesota, Colorado, Illinois, Indiana, North Dakota, Texas and Wisconsin.

  • Farmers Bureau v. White-Rodgers, Hennepin County District Court, State of Minnesota (obtained dismissal for manufacturer of furnace control board).
  • Hi Tech Refrigeration v. ECT, Hennepin County District Court, State of Minnesota (obtained summary judgment for manufacturers of alleged defective component).
  • Kindle v. White-Rodgers, et al., Morgan Superior Court, State of Indiana (member of trial counsel that obtained defense verdict for LP gas control manufacturer after four-week jury trial involving one fatality and four injuries sustained in large LP gas explosion).
  • Vigilant Insurance v. Rheem Manufacturing et al., Hennepin County District Court, State of Minnesota (obtained dismissal in a property damage case for manufacturer of an allegedly defective heating element in a commercial water heater).
  • Brownfield v. AG CO-OP Services Inc., et al., Circuit Court of Cooper County, State of Missouri (obtained dismissal for LP gas control manufacturer in a wrongful death case where co-defendant gas company paid out policy limits).
  • VFW Post 248 v. Scotsman, Inc., et al., LeSueur County District Court, State of Minnesota (trial counsel for component solenoid manufacturer in an electrical fire matter resulting in directed verdict for defendant at close of trial).
  • Polkoski v. General Electric, et al., United States District Court, Western District of Wisconsin (trial counsel for thermal relay manufacturer in an electrical fire matter resulting in defense jury verdict).
  • R & R Properties v. Celotex Corporation, et al., LaCrosse County Circuit Court, State of Wisconsin (trial counsel for insulation manufacturer in product liability matter that resulted in defense jury verdict).
  • Van DeGejuchte v. White-Rodgers, et al., Grundy County Circuit Court, State of Illinois (member of trial team for gas component manufacturer in a wrongful death matter resulting in jury verdict for defendant).
  • Farley v. Pittsburgh Comfort Tech., et al., Allegheny Court of Common Pleas, Commonwealth of Pennsylvania (trial counsel for manufacturer of gas furnace thermostat in a wrongful death case resulting in dismissal at trial).
  • Hendrickson v. Maytag, United States District Court, District of Minnesota (represented refrigerator manufacturer in an electrical fire matter resulting in summary judgment for defendant).
  • Tobias v. Emerson Electric Co., United States District Court, Western District of Oklahoma (represented gas control manufacturer in a gas fire matter resulting in dismissal of claim at trial).
  • Morales, et al. v. Pearman Oil and LP Gas, et al., Ellis County District Court, State of Texas (represented gas control manufacturer in an LP gas explosion matter involving three fatalities resulting in dismissal of plaintiffs’ claims prior to trial).
  • Fried, et al. v. Brass Craft Manufacturing, et al., Jackson County District Court, State of Missouri (represented water heater control manufacturer in scald case involving a fatality resulting in dismissal of plaintiffs’ claims prior to trial).
  • Easter, et al. v. Evcon Industries, Inc., et al., United States District Court, Eastern District of Oklahoma (represented manufacturer of furnace gas control in an LP gas explosion matter involving multiple fatalities resulting in dismissal of plaintiffs’ claims).
  • Jarnigan v. Fisher Controls International Inc., et al., Polk County District Court, State of Iowa (represented manufacturer of LP gas regulator in a personal injury matter resulting in summary judgment – appellate decision reported at supra, 573 N.W.2d 34).
  • Bitler v. A.O. Smith Corporation et al., United States District Court, District of Colorado (trial counsel in case involving alleged gas explosion caused by water heater – reported at 391 F.3d 1114 (10th Cir. 2004)).
