Kelly, a former prosecutor, focuses her practice on representing plaintiffs and defendants in complex commercial litigation.

Kelly’s practice focuses on complex commercial litigation, including matters involving fraud, breach of contract and breach of fiduciary duty, commercial lending disputes, commercial real estate development and landlord disputes, insurance coverage, and other commercial contract and business tort disputes.

  • Defending one of the nation’s largest banks in state and federal courts against claims of fraud, breach of fiduciary duty and breach of contract.
  • Counsel to clients in insurance litigation, including declaratory judgment actions, bad faith suits, subrogation actions and disputes among insurers.
  • Successfully representing a national franchisor in termination of franchise agreements and securing appropriate injunctive relief to protect franchisor’s intellectual property and trade secrets.
  • Assisting commercial lenders in disputes regarding debt collection and debt restructuring.
  • Representing numerous commercial and residential landlords with respect to evictions, lease violations, tenant improvements and other lease disputes.
  • Obtaining favorable resolution for founding limited partner in a complex partnership dispute, including claims for injunctive relief, breach of contract, wrongful dissolution and breach of fiduciary duty.
  • Representing real estate developers and construction companies in development, construction and negligence disputes.
  • Counsel to developers, owners, general contractors and subcontractors in contract disputes and actions involving the foreclosure of mechanic’s liens.
