Alison's securities-related experience includes defending broker-dealers and registered representatives against claims of violations of state and federal securities laws, negligent supervision, breach of fiduciary duty and control person liability in court proceedings and arbitrations before FINRA. Recently, Alison played an instrumental role in the successful defense of a firm client broker-dealer against claims by a formerly associated independent registered representative for wrongful termination and defamation, among other claims, seeking over $6 million in damages, which concluded in a week-long FINRA arbitration proceeding in which the arbitrators awarded a take nothing victory in favor of the broker-dealer.
Alison also regularly represents major financial and lending institutions and mortgage companies in complex commercial foreclosure proceedings, including judicial and statutory non-judicial proceedings and the installation of receivers in commercial properties pending the completion of foreclosure, and the defense of FDCPA, TILA, consumer fraud, wrongful foreclosure and other related claims in both state and federal courts.
She has experience advising and assessing risk for Fortune 500 firm clients regarding the operation, interpretation and enforceability of use restrictions and restrictive covenants, easements, lease agreements and land sale contracts. She also has litigated and negotiated the resolution of matters involving title, lease, land sale and restrictive covenant disputes.
