Amanda R. Cefalu

Amanda Cefalu practices in the areas of ERISA litigation and counseling, employee benefits, employment law and commercial litigation. She has litigated trade secret cases involving nutritional supplements and laboratory testing methodologies, breach of contract and fraud claims and breach of fiduciary claims brought against trustees and fiduciaries of multiemployer pension and welfare plans.

Amanda’s employee benefits practice is focused in litigation but includes advisory work to assist clients in protecting plan assets. She assists trustees and fiduciaries with litigation avoidance and defense of claims brought pursuant to ERISA, such as those alleging claims for breach of fiduciary duty, benefit denials, misrepresentation claims and improper plan management and fees. She also represents plan clients in federal court seeking to recoup delinquent contributions, enforce plan auditing programs and to collect withdrawal liability.

Closely related to her work in benefits, Amanda also counsels employers and represents clients in state and federal court in employment law matters, including discrimination and harassment claims, retaliation, sexual harassment, FMLA, wrongful discharge and non-compete claims. She has practiced before various state and federal agencies, including the Equal Employment Opportunity Commission, the Department of Labor and state and local fair employment agencies.
