Dale’s diverse commercial law practice includes representation of Fortune 100 companies on a variety of litigated and non-litigated matters.  He is committed to clients and achieving favorable results.  

Clients frequently need sound legal advice to achieve a desired result or, in many instances, a lawyer with the right experience to effectively advocate on their behalf in the courtroom. Dale's diverse commercial law practice is singularly focused on delivering favorable outcomes and solutions to his clients. His significant jury trial experience provides real value to clients in litigated matters as well as for clients addressing business matters in an effort to minimize the risk of being involved in litigation. Some of Dale's clients include financial institutions, medical providers in medical malpractice matters, commercial contractors, and Fortune 100 companies in tort and commercial matters. He also represents clients pertaining to land use, zoning, and other governmental regulation and frequently counsels business clients of all sizes concerning everyday business issues.

In many instances, Dale's undergraduate degree in Business Administration is an invaluable resource during the course of his representation because he can readily gain a fundamental understanding of and appreciation for his clients' business organization, stakeholders, and objectives. Cost effective, favorable outcomes are a hallmark of his law practice.

  • Successfully defended client in federal court against breach of contract and unfair and deceptive trade practices act claim governed under North Carolina law.   The client’s Rule 12(b)(6) motion to dismiss for failure to state a claim upon which relief can be granted resulted in the court dismissing both counts with prejudice. 
  • Represented client in an original action before the Supreme Court of Arkansas arising out of a challenge to a proposed initiated constitutional amendment. The representation included trying issues of fact to a special master appointed by the supreme court.
  • Orally argued before the United States Court of Appeals for the Eighth Circuit on behalf of clients relating to claims governed by the Federal Telecommunications Act, resulting in a favorable outcome.
  • Obtained defense verdicts in separate, multi-day jury trials in state and federal court for commercial businesses, including a Fortune 100 company, arising out of alleged personal injuries.
  • Obtained defense verdict on all counts following a jury trial arising out of medical malpractice, negligence, breach of contract, and deceptive trade practices claims against health care provider, management, and owner.
  • Obtained defense verdict after multi-day jury trial in a substantial fire case defending an electrician against negligent installation of electrical service and wiring claims.
  • Representation of commercial food supplier against claims of negligence, breach of contract, and other causes of action arising out of allegedly nonconforming food products distributed nationwide that resulted in a manufacturer recall.
  • Representation of a shopping mall owner against adjoining landowner’s tort claims arising out of a large-scale commercial development.
  • Representation of health care providers against claims of medical malpractice.
  • Representation of employer before the Arkansas Court of Appeals on an issue of first impression concerning its entitlement to a statutory credit against awarded indemnity benefits pursuant to the Arkansas Workers’ Compensation Act, which resulted in a favorable outcome for the client.
