Long-Term Care Regulatory

For more than three decades, Kutak Rock has been a leader in providing legal services to providers of long-term skilled nursing, assisted living with memory care units and to the continuing care retirement communities (CCRCs). We represent both not-for-profit and proprietary providers in tax-exempt and taxable financings, and also in general corporate matters including restructuring and mergers and acquisitions.

In addition, we provide general regulatory counsel to long term care facilities with respect to licensure, certificate of need (CON), Medicare and Medicaid certification, accreditation, compliance and risk management.  Our Risk Management program allows cost-effective guidance for day-to-day operational issues as well as evaluation and response to medical records requests and self-disclosure matters.

Kutak Rock has developed relationships with representatives of a variety of state and federal agencies to promptly address our clients’ regulatory issues.  Kutak lawyers routinely appear before state and federal agencies, commissions, licensing boards and address concerns raised by the State attorneys general and administrative law judges. With respect to State and Federal Survey issues, we provide comprehensive operational legal advice to facility administration, including preparation and submission of their Plans of Correction and, when necessary, file and pursue appeals taken from a survey deficiency or audit finding, or any adverse administrative action affecting the healthcare provider’s continued operational compliance.
