Last year, the Internal Revenue Service (IRS) announced the elimination of the determination letter program for individually designed qualified plans (subject to certain limited exceptions) effective January 1, 2017. The announcement created significant uncertainty for plan sponsors regarding how to keep their plans qualified in light of law changes after 2017. On June 29, the IRS released guidance that attempts to clarify a number of issues surrounding the elimination of the determination letter program. Last week, the IRS announced changes to its voluntary program that allows employers to correct retirement plan operational errors. The program, known as the Employee Plans Compliance Resolution System (EPCRS), allows employers to correct operational errors by either (i) seeking IRS approval of a proposed corrective action; or (ii) self-correcting by taking a prescribed corrective action.Please read our client alert for additional information.

Late Friday afternoon (October 31, 2014), the Center for Medicare & Medicaid Services (CMS) announced it will not be enforcing the regulations relating to unique health plan identifiers (HPIDs) until further notice. The enforcement delay applies to all HIPAA-covered entities, including health plans.
