On December 28, 2015, the Internal Revenue Service issued Notice 2016-4 (the “Notice”), which extends the due dates for furnishing and filing the new Affordable Care Act reporting forms for the 2015 calendar year.  The extended deadline for furnishing the 2015 Form 1095-C and Form 1095-B to individuals is March 31, 2016 (it was February 1, 2016).

On December 18, President Obama signed the Consolidated Appropriations Act, 2016 (the Act) into law. The Act amends the Patient Protection and Affordable Care Act (the ACA) to delay the effective date of the so-called “Cadillac tax” to 2020. Earlier this year, the U.S. Department of Health and Human Services Office of Civil Rights (OCR) announced that it would be conducting “Phase 2 Audits” of covered entities and business associates for compliance with the privacy and security rules under the Health Insurance Portability and Accountability Act (HIPAA”). These audits will focus, in part, on a covered entity’s or business associate’s security risk assessments, mitigation plans, breach notification procedures, encryption and training and the necessary privacy and security policies and procedures. The OCR expects that these Phase 2 Audits will commence in the fourth quarter of 2015 and into 2016. For additional information, please read our client alert.
