As the majority of our nation’s population nears retirement age, the need for assisted living and nursing facilities has skyrocketed—and so has the scrutiny under which they operate.

Kutak Rock’s team of national health care attorneys represents owners and operators of long-term care facilities, including assisted living, nursing, residential care and independent living facilities located in communities throughout the United States.  Our expertise in long-term care licensure, certification, reimbursement and other regulatory matters is available to support real estate and financing counsel handling transactions involving the acquisition or sale of facilities.

In addition, we provide general regulatory counsel to facilities with respect to licensure, certificate of need (CON), certification, accreditation, compliance and risk management.  Our Risk Management program allows cost-effective guidance for day-to-day operational issues as well as evaluation and response to medical records requests.

Kutak Rock has developed relationships with representatives of a variety of state and federal agencies and we frequently appear before several state and federal agencies, commissions, licensing boards, attorneys general and administrative law judges. With respect to State and Federal Survey issues, we provide comprehensive support to facility administration, including preparation and submission of the Plan of Correction and, when necessary, file and pursue appeals taken from such survey deficiency findings, adverse administrative actions and employee neglect or abuse findings.
