Ms. Cappellano focuses her practice in litigation and employment law. She has successfully defended clients in state and federal courts, including those in Nebraska, Iowa, Colorado, Texas and Tennessee. Ms. Cappellano has significant experience litigating matters asserted under Title VII, the Family Medical Leave Act (“FMLA”), the Americans with Disabilities Act (“ADA”), the Age Discrimination in Employment Act (“ADEA”) and the Uniformed Services Employment and Reemployment Rights Act (“USERRA”), as well as state anti-discrimination laws. She has a high degree of success obtaining summary judgment on discrimination, harassment and retaliation claims.

Ms. Cappellano also has experience litigating cases involving noncompete agreements, corporate raiding, misappropriation of trade secrets and breaches of fiduciary duties by employees, officers or directors. In addition, she has handled employment arbitrations pending before FINRA and the AAA.

Ms. Cappellano regularly counsels employers on day-to-day issues such as employee discipline, wage payment, drug testing, application of the ADA and the FMLA, termination, and unemployment and workers’ compensation issues. She also has significant experience drafting employment agreements, restrictive covenants and confidentiality or nondisclosure agreements, executive indemnification agreements, severance agreements, and employee handbooks.

Ms. Cappellano has been successful in defending employers against charges of discrimination, harassment and retaliation filed with federal, state and local administrative agencies. She also has successfully defended against charges filed with the National Labor Relations Board.

  • Successfully defended clients in employment matters in Nebraska, Iowa, Colorado, Texas and Tennessee, on matters filed under Title VII, the ADA, the ADEA, the FMLA, and USERRA.
  • Provides daily counsel to employers related to personnel issues, employee handbooks, policies and procedures, and in drafting employment agreements, restrictive covenants and termination documents, among other employment-related documents.
