Eric R. Sender

Eric concentrates his practice in the areas of commercial lending, banking and public finance. He routinely represents domestic and foreign commercial banks and other financial institutions as direct lenders and as providers of credit enhancement and liquidity support for publicly traded debt securities. Eric has extensive experience representing purchasers in private placements of taxable and tax-exempt bonds (including bank qualified bonds and qualified tax credit bonds) issued for the benefit of states, cities and local governments, healthcare groups and higher education institutions located through the country. In addition, he serves as counsel to commercial banks and insurance companies as providers of structured investment products such as guaranteed investment contracts, repurchase agreements and forward delivery agreements.

  • Represented financial institutions in their direct purchase of: 
    • $200 million of indexed floating rate bond issued by a large city
    • $10 million of industrial development revenue bonds issued for the benefit of a manufacturing company to finance real property improvements and equipment purchases
    • $85 million of refunding revenue anticipation certificates issued for the benefit of a major healthcare system
    • $7.5 million of drawdown revenue bonds issued for the benefit of a private school
    • $107 million of bonds issued to finance a sports stadium project
    • $10 million of certificates of participation structured as qualified zone academy bonds issued to create health science, engineering and vocational academies in public high schools in two school districts
    • $30 million of gulf opportunity zone bonds issued to finance capital improvements at a large university
  • Represented bank which provided a $140 million letter of credit supporting variable rate bonds issued for an airport financing by a city.
  • Represented bank which provided a $12 million revolving credit facility to a company for working capital purposes which was secured by real estate, accounts receivable and inventory.
  • Represented financial institution in developing programmatic form documentation for the sale of participation interests in a portfolio of bond and lease-purchase financings. 
  • Represented bank which provided over $100 million in liquidity support for revenue bonds issued for the benefit of a large health care group, and provided a $17 million revolving loan and letter of credit agreement. 
  • Represented bank which provided a $37 million letter of credit supporting variable rate bonds issued to finance the construction of off-campus student housing at a large university. 
  • Represented financial institution which provided a $15 million term loan to a public corporation to finance real property acquisitions and improvements.
