Ms. Wineland practices in the areas of commercial, complex, class action, insurance and general litigation. She has tried over 75 jury trials as lead counsel. Her cases have covered a wide range of subject areas, including contract, fraud, deceptive trade practices, trade secrets, products liability, insurance coverage, and personal injury. She also has handled numerous non-jury trials, mediations, appeals, and large-scale eDiscovery projects.  She has obtained numerous defense verdicts, summary judgments, dismissals and favorable settlements for her clients.

Ms. Wineland chaired the Arkansas Supreme Court Committee on Model Jury Instructions – Civil for the 2011 and 2012 editions. She is active in the Arkansas Bar Association, having served in the House of Delegates, on the Executive Council and Board of Governors, on the Editorial Advisory Board of The Arkansas Lawyer, and as chair of the Legislation Committee. She is a past president of the Arkansas Bar Foundation and the Arkansas Association of Defense Counsel, and served on the board of Arkansas Volunteer Lawyers for the Elderly. She also belongs to the American and Pulaski County Bar Associations. 

Ms. Wineland is a member of the Defense Research Institute and a former state representative to DRI. She is on the National Board of Directors of the American Board of Trial Advocates where she co-chairs the Membership Committee. She has served as president of the Arkansas chapter of ABOTA and has participated in Masters in Trial programs sponsored by the American Board of Trial Advocates in Arkansas and elsewhere. She has been a member of the International Association of Defense Counsel and is on the faculty of the Arkansas Professionalism Practicum.

Cases of Interest:

  • Defeated class certification in consumer fraud case against the nation’s largest manufacturer of caskets.  Clayton v. Batesville Casket Co., Inc., no. 4:11-cv-00014, in the United States District Court for the Eastern District of Arkansas.
  • Subsequently obtained summary judgment in favor of same manufacturer in individual claim.  Clayton v. Batesville Casket Co., Inc., 2015 Ark. App. 361.  
  • Defended large retailer in consumer class actions involving orange juice allegedly containing arsenic, children’s jewelry allegedly containing cadmium, claims of overcharging, and others.
  • Defended large retailer in employment class action alleging race discrimination in hiring.
  • Defended nursing home chain in employment class action alleging violation of Fair Labor Standards Act.
  • Defending large retailer in securities fraud class action.
  • Obtained dismissal of shareholder derivative litigation against large retailer.
  • Successfully argued for affirmance of dismissal of claim against CEO of nursing home individually in case alleging deficient nursing home care.  Bayird v. Floyd, 2009 Ark. 455.
  • Representing large retailer in breach of contract case with website developer.
  • Represented provider of physical therapy services in breach of contract case against physicians group.
