Stuart C. Hindmarsh

Partner

Stuart enjoys handling complex legal issues to meet client needs and mitigate risk. His practice involves commercial transactions and contracts, including real estate, financial institutions, and corporate matters. He’s also passionate about diversity and inclusiveness, and is currently Co-Chair of Kutak Rock’s Well-Being Initiative and a member of its National Inclusiveness and Diversity Committee.

Stuart has extensive experience with real estate matters.  He has represented large and small businesses in billions of dollars’ worth of real estate acquisitions, leases, easements, developments, and other real estate matters. He has managed teams of attorneys on real estate portfolio work for securitizations and other finance transactions secured by hundreds of commercial and multifamily properties across the country. He has substantial land use and compliance experience which includes handling projects involving thousands of operating locations for a Fortune 500 client. He has experience representing telecommunications clients, including creating forms of agreements for the development and launch of a publicly traded client’s RFP and no-bid project delivery systems for new tower assets.  He has also represented multiple healthcare clients in the acquisition and disposition of both operating and administrative facilities, whether by lease or purchase.

Stuart has ample experience assisting financial institutions and other lenders.  His banking and lending experience includes both operational and transactional matters such as commercial loans (including those collateralized by real estate and other business assets), workouts, deeds-in-lieu, treasury management services, financial services, customer service agreements, and vendor management.

Stuart’s experience has allowed him the opportunity to serve as seconded in-house counsel for a Fortune 100 client on separate occasions.  During these assignments, Stuart served as the primary legal contact for the client’s US operating locations’ day-to-day facilities and realty matters and then as legal support for its wholesale division, handling legal projects for various business lines. These opportunities provided him a valuable “inside-out” perspective of meeting client needs while addressing the client’s internal processes, financial objectives, and legal risk.

Other aspects of Stuart’s practice involve helping clients with many different kinds of commercial agreements, whether they be supplier, licensing, sales, service, confidentiality, or other agreements.  Stuart enjoys learning about his clients’ businesses and formulating and implementing novel legal solutions for their emerging business issues and strategies.
