Kutak Rock LLP attorney Stephen Dacus was featured in the Northwest Arkansas Business Journal article “As Technology Rapidly Changes, Legal Industry Strives to Keep Up,” on February 26, 2015. In the article, Dacus provides insight on the complex issues of electronic discovery (e-discovery).

The article discusses changes to e-discovery procedures under the Federal Rules of Civil Procedure. The new federal rules, effective December 1, 2015, include, among other things, a more comprehensive definition of electronically-stored information, provisions allowing random sampling of data to prove or disprove relevance, and guidelines on proportionality of the lawsuit to the cost of producing data. The new rules also require the parties to discuss many important aspects of e-discovery at the outset of federal court litigation. Dacus supports these new measures, explaining that “encouragement to have an early, frank discussion on e-discovery is a good step.” Dacus also notes that many of the new e-discovery rules are in line with his current practice, but adds that “the federal rules are moving in the right direction” after the recent rule changes.
