Mr. Shaw is of counsel in the firm's Kansas City office. He focuses his practice on bankruptcy and creditors’ rights with particular interest in financial services. He has experience enforcing loan agreements, promissory notes, security instruments, guaranties and other commercial contracts. Mr. Shaw draws on a broad commercial litigation background in loan enforcement, bankruptcy, and real estate and title insurance litigation.

Some of Mr. Shaw’s representative experience includes:

  • Regularly represents banks and loan servicers in loan enforcement and foreclosure actions, and regularly represents title insurance companies in defending insured parties on lien priority and title claims.
  • Defended claims against mortgage-holder in case where another creditor alleged a superior security interest in real estate based on purportedly lost, prior mortgage, and obtained a quick and efficient dismissal of all claims by filing aggressive dispositive motions in the case.
  • Represented a bank in a complex, time-sensitive foreclosure action involving a leasehold mortgage interest on commercial real estate owned by a municipality and subject to requirements under a bond indenture. A summary judgment was obtained on the amounts owed to the bank and the negotiation of the sale of the property was assisted to satisfy those amounts.
  • Represented an agricultural equipment supplier in a dispute with a vendor that had failed to make required invoice and financing payments. It was resolved and a favorable settlement of the dispute was obtained on behalf of the supplier which avoided potentially costly litigation.
  • Advised local business regarding noise, occupancy and parking issues in dispute with neighboring businesses and advised on procedures to avoid further disputes and potential municipal ordinance violations.
