Mr. Irvin practices in the area of public finance, including health care, student loan and traditional municipal finance transactions. He is bond counsel to numerous student loan issuers throughout the country and is a member of the Education Finance Council, one of the leading national student loan finance organizations. In Colorado, Mr. Irvin serves as bond counsel to the Colorado Health Facilities Authority on hospital and other health care financings, as well as the University of Colorado Hospital Authority and Denver Health and Hospital Authority. He is also bond counsel to various cities and urban renewal authorities in the State of Colorado and the Denver Urban Renewal Authority. He also assists clients throughout the country as underwriter’s counsel for a variety of transactions.

Mr. Irvin served as Vice Chair of Kutak Rock and as Managing Partner of the Denver office for an eight-year term ending in May of 2016.

Representative Experience

  • Bond counsel for state and local issuers in conduit financings, including health care, other 501(c)(3) borrowings and industrial development revenue bonds. Financings for private non-profit hospitals include Boulder Community Hospital, The Children’s Hospital Association, Longmont United Hospital, North Colorado Medical Center, Platte Valley Medical Center, San Luis Valley Regional Medical Center and Valley View Hospital.
  • Bond counsel on multiple financings which allowed the University of Colorado Hospital and The Children’s Hospital to move to and further expand at the nationally renowned Fitzsimons Campus in Aurora.
  • Bond counsel on hospital transactions and restructurings, including public-private partnerships and use of various tax credit facilities.
  • Bond and underwriter’s counsel for tax-exempt and taxable student loan issues throughout the country with respect to both Higher Education Act student loans and private, or alternative, student loans, including fixed rate bonds, variable rate demand bonds and LIBOR floating rate note structures.
  • Represents local governments in Colorado, including the City of Boulder, for general obligation and revenue bonds, as well as certificates of participation.
  • Bond Counsel on certificates of participation financing for the City of Colorado Springs which provided a new national headquarters for the United States Olympic Committee in order to retain the headquarters in Colorado Springs.
  • Bond Counsel to urban renewal authorities, including the Denver Urban Renewal Authority, for tax increment financings. Financings include major development projects along the Denver 16th Street Mall, and redevelopment of the former Denver Stapleton Airport into one of the country’s largest mixed use developments.
