Nicole Moriarty is a partner in the Washington, D.C. office, practicing primarily in the area of complex commercial litigation and general civil litigation. Her experience extends to a variety of matters including financial services litigation, antitrust litigation and Hart-Scott-Rodino (HSR) filings, government contracts litigation and compliance, bankruptcy and creditors’ rights litigation and general contract disputes.

Ms. Moriarty also has experience advising clients on a wide range of privacy and data security matters and is a member of the International Association of Privacy Professionals.

Ms. Moriarty recently served as one of the lead attorneys seeking to recover more than $16 million of preference payments and fraudulent transfers on behalf of the chapter 7 trustee of a government contractor. Currently she is part of a team of attorneys prosecuting Sherman Act claims against a state regulatory board made up of active market participants, implicating the U.S. Supreme Court’s 2015 state action immunity decision in North Carolina State Board of Dental Examiners v. FTC, 135 S. Ct. 1101 (2015). Prior to this, she helped represent a financial guarantor in a multibillion-dollar breach of contract and fraud case against a major mortgage lender.

Before joining Kutak Rock, Ms. Moriarty helped represent banks, finance companies, insurance companies and other financial service providers in consumer financial services and banking litigation. Her experience includes the defense of class action and single-plaintiff litigation matters involving federal consumer protection statutes such as the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Truth in Lending Act and Equal Credit Opportunity Act, as well as the defense of matters involving the Virginia Consumer Protection Act and other state consumer credit laws.
